This Ordinance regulates the legal relations between BitLab d.o.o. Banja Luka and service users. This Ordinance shall enter into force on the day of its publication and shall remain in force until amended.
Service user is a legal or natural person who buys the use of services from BitLab or orders a service from BitLab.
This Policy applies to all users who have leased hosting, registered domains, leased IP addresses and SSL certificates with BitLab.
The policy aims to prevent illegal activities or possible misuse of BitLab servers, respecting freedom of speech and expression if it is not harmful to others, protecting the integrity and privacy of users, as well as ensuring the security and reliability of the network.
By ordering / using the services of BitLab, the user accepts the rules of conduct contained in the Ordinance, which means that he will not take actions that are contrary to this Ordinance.
If the user signs an agreement with BitLab on the use of services, the provisions of that agreement will take precedence over this Ordinance.
BitLab will protect the confidentiality of private data provided to it in connection with the establishment of the user relationship and use it only for its own needs and for purposes specified by law. Read more about this at the bottom of this document: Privacy Policy.
In case of changes in the data related to the user's registration (address, phone, name, etc.), the user is obliged to notify BitLab about the changes without delay in writing, in writing or by e-mail, and no later than 8 days from the date of the changevnom, all correspondence will be sent to the last known address and delivery based on existing data will be deemed to have been duly made.
BitLab guarantees the confidentiality of information contained in project materials, and the protection of trade secrets, intellectual and industrial property, patents contained in these materials, regardless of whether they are registered or not.
BitLab cannot be held responsible for the security of data provided by insecure channels over which it has no control.
Any person can make a request to use BitLab services. When submitting a request, the person is obliged to provide accurate contact information: name, address, telephone, e-mail address. If incorrect information is provided (incorrect phone, email address), BitLab will no longer process the submitted request.
By opening a user account, the user agrees that BitLab may contact him for regular communication related to the service he uses, as well as for extraordinary notices and offers.
BitLab will endeavor to deliver all notifications by email.
In order to provide some services, BitLab will provide the user with a username and password (or more) that authenticate access to the services provided by BitLab. The user is obliged to keep the credentials received, not to give them to unauthorized persons and is obliged to take care of the security of the computer on which this data is located, to protect it from hackers, viruses and other unwanted software.
User is responsible for all activities performed under his username and password.
In case of misuse of orders, suspicious activities or consecutive requests that we cannot verify with the client, BitLab reserves the right to suspend the client's account, request additional verification documents or terminate the business relationship. In case of unilateral termination, during the lease period, the client has the right to migrate his services to another provider within 15 days.
In case of misuse or suspicion of misuse of the username, the user agrees that BitLab has the right to charge him for all costs incurred under his username, until the moment of reporting the misuse of BitLab.
BitLab is able to change the client's password upon receipt of a written request, with proof that the client is the owner of the service. Telephone requests are not acceptable. Access parameters are not sent to addresses not specified in the user account.
BitLab is committed to providing leased services in the best possible way, including: monitoring the operation of servers and other technical equipment, upgrading servers, expanding capacity according to the number of users, customer support, troubleshooting and troubleshooting.
BitLab has the right to ask the user to reimburse the costs caused by unacceptable or unauthorized use of services.
BitLab reserves the right to disable or terminate users' access to any service in the event that it is assessed that the service is not being used properly.
In order to ensure the free and undisturbed use of services, these procedures are unacceptable and strictly prohibited:
BitLab performs technical maintenance of the system, change of operating system and software from old versions to new ones, change of hardware for better performance, change of internet connections and other technical improvements. All these changes are done in the best intention to improve service or in order to eliminate current and potential future problems. During these changes, some of the services may be unavailable or have difficulty operating.
In the event of planned performance improvements that may affect the ability to deliver services to the user, BitLab will notify the user of planned system upgrades. However, BitLab reserves the right to upgrade and make changes to server software and hardwarewho share shared hosting without consulting with the users of those hosting. In case the user leases the entire server from BitLab (and if BitLab maintains it), significant changes in the server configuration are made in consultation with the user.
In the event of a system crash, server attack, etc., BitLab will initiate emergency procedures and initiate emergency system repairs without prior notice.
In the event of a crash, BitLab will attempt to recover all data related to the user's service located on BitLab's or the user's backup system, if technically feasible.
BitLab is not responsible for missing or damaged user files. The user assumes full responsibility for all files on the leased hosting, as well as for maintenance and backup of the same. The user has the option to create and download backup from the user panel.
BitLab backs up all sites once a week.
By agreement, the user can ask BitLab for help with restoring Backup.
Expected hosting availability is 98% or more annually.
The user is fully responsible for the entire content of the site hosted on BitLab servers. It is forbidden to present content that may be harmful to BitLab servers or any other server on the Internet, as well as posting links to such content on the Internet Examples of unacceptable content: pirated software, hacker programs or archives, warez sites, irc, etc.
It is not allowed to transfer or present any information, data or material that is contrary to the legal regulations of the Republika Srpska and BiH, which commits a criminal offense or economic offense, violation of copyright and industrial property rights, offense unfair competition, violation of good business practices and any other conduct contrary to generally accepted moral principles.
Unauthorized access to other users' content, changes to the content, deletion or any processing of the content is not allowed.
Users of CMS content management systems (WordPress, Drupal, Joomla, Magento, etc.), as well as all other scripts that they place on their hosting with BitLab, are required to monitor developments in the field of security and protection of such systems and to remove known vulnerabilities by regular maintenance and application of patches and updates.BitLab is not responsible if there is an intrusion on the user's site due to omissions on the site.The user is obliged to apply protection measures.If the intrusion occurs, BitLab will suspend user hosting and inform the user about the security measures, and the user is obliged to implement these measures.The user is obliged to clean the infected files and inform the technical support by ticket and only then the hosting will be reactivated.If the user can not clean the infected files, he can with the help of BitLab, with appropriate compensation.
BitLab will not actively monitor the work of users in order to ensure compliance with the rules of conduct. The user of BitLab is obliged to cooperate in taking preventive and corrective actions to prevent violations of the Rules.
User verification is performed on the basis of a complaint from a third party and in that case the procedure is as follows:
BitLab reserves the right to change or suspend, in the event of an emergency, any site, account, database, or any other component of the Site that it deems to be causing problems or heavy server loads.
If a client's hosting account is hacked (intrusion, virus or spam from that account), BitLab's procedure is as follows:
The user is responsible for the correctness of the order through the BitLab site and payment for it. BitLab is not responsible if the user makes the wrong order. The service will be realized, and subsequent changes are not possible. the domain name is incorrectly submitted to the order and the order is paid for, the domain will be registered and no refund is possible. Only re-ordering and payment of the desired domain is possible (assuming it is available for registration).
Domains are registered for a certain period (usually one year) and BitLab will allow the domain to function during the registered period. that the client will be able to continue using the domain.
If the domain is not renewed before it expires, the domain will be deactivated (suspended) and cannot be used.
Changing domain parameters, according to the architecture of the Internet, takes some time to refresh these new parameters on all servers. BitLab does not guarantee that your domain will be available immediately after changing the DNS record.
Important note: Domain transfer (change of domain registry, ie the person who registers and maintains the domain for you) cannot be done 60 days after domain registration or if there are less than 30 days left until the domain expires.
For registration of .BA and .HR domains, the client needs to send by mail or deliver personal documentation in BitLab. In case the documentation does not come or is not correct, the domain will not be registered.
BitLab has the right not to register the ordered .BA or .HR domain before receiving the necessary documentation.
By ordering and registering a .BA domain, it is understood that you fully accept the .BA Domain Registration Policy.

Any activation / deactivation of the domain, caused by the user's failure to submit documentation or poor documentation and communication, is to the detriment of the client, and will be charged separately.
The user is responsible for placing an order through the BitLab site or via e-mail and paying for it. The user is obliged to find out in advance about the specifications of the hosting package he wants to rent. .rs or by contacting technical support via a ticket. BitLab is not responsible if the user has rented an inadequate hosting package. BitLab can meet the requirements for switching to a larger package with an adequate surcharge, which is in accordance with the valid price list.
Realization of the order (domain registration, opening a hosting account, audio streaming, purchase of SSL certificate) will be performed after receiving payment for ordered services. Additional services (IP address lease, server lease) are realized after receiving payment and procurement process without a specified period of time. Bitlab has the right to reject any order without a stated reason.
After the order is placed, the user is provided with a proforma invoice for BitLab services, with instructions for making payments. BitLab sends proforma invoices exclusively electronically, via e-mail, to the address provided by the user to BitLab.
There are four payment methods: payment by bank transfer (as a natural person), payment by proforma invoice (as a legal entity), payment by card (online) and bank transfer (for users from abroad).
Customer relationship means all services agreed between the user and BitLab for a certain period of time, for which the user has made a payment in full. BitLab services are charged and charged according to the valid price list.
BitLab reserves the right to change the price list, which it will inform users by posting on its website or in another appropriate way.
The price list change takes effect within 7 (seven) days from the date of publication.
The changed price for existing users will be applied when renewing services after the expiration of 30 days from the date of publication of these changes on the official website of BitLab.
BitLab may specify a price different from the current price list by proforma invoice, offer or contract. For services whose price is not determined by the price list, BitLab determines the price by proforma invoice, offer or contract concluded with the user.
The user undertakes to pay for the services by the due date. Otherwise, in case of delay, BitLab is authorized to charge default interest on unpaid and unpaid receivables, as well as the cost of sending me, and has the right to deactivate the service so that the client would not cause major damage, and in case of reactivation to charge the costs of reactivation.
If the service user does not settle his obligations to BitLab within 30 days from the date of issuing the proforma invoice / invoice, and upon written notice, BitLab may, without further written notice, immediately terminate the user relationship and initiate legal proceedings. billing.
Payment for hosting services, domain registration, lease of IP addresses, SSL certificates is made for a period of one year in advance, unless otherwise agreed.
BitLab will notify the user of the expiration of the lease period 30 days before the expiration of the service.
In case it does not receive a response before the service expires, the service will be suspended after the renewal date.
In the case of hosting services, files will be stored for another 15 days after the recovery deadline. After 15 days, BitLab reserves the right to delete files from the server, without prior consultation with the user.
In case you use an unpaid domain, BitLab has the right to redirect and use the domain for its own purposes.
In case of suspension of the account for any further activity of BitLab regarding the account, it is necessary for the user to make a payment for the renewal of the service and additional costs for activating the account.
In the event of a gross violation of the rules, BitLab has the right to deactivate the service without prior notice.
The dedicated server cancellation period is 30 days.
In case of payment, users from the Republika Srpska and the Federation of BiH will be sent the original invoice by mail. Users from abroad will be sent the original invoice by mail at their personal request.
The Client is obliged to submit to BitLab any change in contact information (name, address, telephone). BitLab is not responsible in case you do not receive a warning, proforma invoice or invoice due to incorrect contact information.
BitLab will primarily use e-mail to communicate with the client, and documents that do not have to go to other channels will be sent via e-mail.
Proforma invoice is sent to the user by e-mail. The user's proforma invoice does not oblige to pay, and without legal consequences it is possible to pay and not pay, and it depends on the user's decision whether the service will remain active or suspended .
After payment, whether the user is a legal entity or a natural person, BitLab is obliged to issue an invoice and send it in its original form, by mail or in person to the user's address.

In the event that the client and Bitlab do not sign an additional service agreement, in the event of conflict resolution, the provisions of this Ordinance shall apply.
If he is not satisfied with the service leased from BitLab, the user can request a refund in full, within 30 days from the date of the order. Refund is possible for shared hosting and streaming services. Refund is not possible for domain registration, IP lease, SSL certificate, VPS or dedicated server services.
The User agrees not to be entitled to any damages from BitLab, which includes claims, losses and costs, including attorney's and litigation costs. BitLab is not liable in the case of:
BitLab from time to time organizes special promotional / action offers for new or existing users. The action offer may include a new provision for the terms of use, which apply only to that action.
All products purchased at the promotion or promotion via the promo code at BitLab cannot be migrated or transferred from BitLab during the first 60 days of the service. If it is necessary to migrate or transfer the service within 60 days, BitLab reserves the right to charge the difference in price to the full price of the service.

BitLab is not responsible for data loss, undelivered messages, incorrectly delivered data, setting up e-mail accounts, as well as for possible interruptions.
BitLab is not responsible for any damage that may occur due to incorrect contact information. The client is obliged to provide timely information on changes in contact information.
BitLab cannot provide immediate removal of content that violates the General Terms of Use.
BitLab does not check or control the content that users place on the space leased from BitLab.
BitLab is not responsible for the operation of the infrastructure required to use BitLab's services, unless BitLab directly controls it.
BitLab provides customer support in good faith, and within the specific circumstances of the individual case. BitLab is not responsible for possible damages and costs incurred in the process of providing customer support.
The user agrees that there is a possibility that the BitLab service will not always be available and that BitLab is not responsible for the damage. The Internet is an international computer network, which BitLab does not control, but is only connected to it. can guarantee the availability of services that are not under the direct control of BitLab.
BitLab will not be liable for any damages or lost profits incurred during the necessary maintenance of the system, which could affect the quality of BitLab's service.
BitLab does not accept any responsibility for any damage that may occur due to temporary or permanent termination of the user relationship due to non-payment of due invoices or violation of the Policy.
BitLab is not responsible for viruses that may be sent to the user via email, FTP, HTTP or other electronic virus transfers. BitLab monitors viruses and attacks that could potentially compromise the hosted BitLab servers. BitLab does not monitor viruses and other malicious software that are on computers, mobile devices of users or are inserted into hosted content, with or without the knowledge of the client due to loss of credentials or omissions on the user's site. and uses antivirus software and other security solutions on mobile devices.
In case the hosted content generates SPAM or otherwise endangers the server, the user account will be excluded. Both parties may terminate the agreement at any time. Fees paid to BitLab, BitLab has no obligation to return.
BitLab and the user agree to try to resolve amicably and with understanding all disputes arising out of or in connection with the user agreement. In case of failure, the District Commercial Court in Banja Luka is competent to resolve the dispute.
The user agrees that BitLab has the right to change the Policy, amend or supplement it without prior notice. Existing users will be notified of changes to the Policy via the BitLab website or otherwise.
The application of the Policy takes effect on the day of its publication on the official BitLab website and applies to all users who have established a user relationship after that day.
